    2004年是南京市知识产权事业全面推进的一年。全市以强化知识产权保护为重点,以开展知识产权保护专项行动为契机,着力构建良好的知识产权法制和保护环境,加强知识产权协调机制的建立,对促进南京市科技、经济发展和社会的全面进步发挥了重要作用。

    南京市人民政府深入推进知识产权保护工作。年初就将知识产权相关工作内容纳入全市经济建设和社会事业发展的目标,由许慧玲副市长与各区县政府、高新技术园区和产业集团签订了年度专利工作目标责任状。同时,市政府调整了知识产权办公会议成员单位,成员单位和列席单位达24家。制定了《南京市保护知识产权三年规划(草案)》,首次向海内外发布了《2003年南京市知识产权保护状况》白皮书。南京市还通过了全国城市专利试点工作验收,并被新批准为国家知识产权试点城市。当年累计列入省知识产权试点的区县达5家,其中3家如期通过验收,1家被新批准为江苏省知识产权区域示范区。
    在“4﹒26世界知识产权日”期间,市政府还召开了知识产权办公会议。省知识产权局与省高级人民法院联合在南京举办主题为“鼓励知识创新,保护知识产权”的“江苏知识产权论坛”,市政府许慧玲副市长就中心城市加强知识产权保护发表演讲。期间省、市知识产权局联合工商、版权、公安、海关、扫黄打非办公室等相关部门和部分专利代理机构,在鼓楼广场开展了大型的知识产权宣传咨询活动,各区县也开展了相关主题活动。5月,市政府许慧玲副市长会见了由香港知识产权署、香港商标师工会和亚洲专利代理人协会组成的知识产权访问团,并就双方在加强知识产权保护方面的合作交换了意见。访问团还与省知识产权局在南京共同举办了“苏港知识产权保护研讨会”。从9月份开始,南京市还开展了保护知识产权专项行动,市政府办公厅印发了《南京市保护知识产权专项行动实施方案》

    2004年全市专利申请量大幅增长,年专利申请量达3908件,同比增长26.6%,其中发明专利1414件,实用新型专利1422件,外观设计专利1072件,发明专利申请继续保持省内领先地位。年内专利授权1883件,其中发明、实用新型和外观设计三类专利授权量分别为474件、922件和487件。我市一批区县专利工作取得较大进步,在全省三个申请量超800件的县(市)中,玄武区、鼓楼区分别以945件、818件名列2、3位。全省申请量前10位高校中,南京高校有8家,其中南京大学、东南大学在全国高校专利申请中分别排第9位和11位,在全国高校发明专利申请中分别排第7位和第13位;有部分企业跻身企业申请量国内百强和省十强。专利代理机构也有新的发展,目前全市拥有专利代理机构10家,其中被国家知识产权局批准的有涉外代理资质的有4家。全年共代理专利申请4682件,其中代理南京地区的申请3534件,占75 %。
    南京市加强对专利实施的引导支持,重点对电子信息、汽车制造、生物医药、环境保护、现代农业和新材料、新能源等技术领域的专利技术实施给予支持,全年安排科技三项经费600万元,设立重大专利实施和专利二次开发计划。同时,继续引导企业建立相关的管理制度,全市有68家企事业单位分别列入“省企事业知识产权管理工作推进计划”和“省重点领域企业和行业知识产权战略计划”。
2004年专利行政执法进一步强化。江苏省知识产权局、南京市知识产权局和相关区县知识产权管理部门,共同成立了联合执法小组,先后检查了10多家商场和药房,检查商品200多种。全年共立案查处冒充专利案件3起,调解处理专利纠纷4起。

    2004年,南京市工商局根据《南京市著名商标认定和保护办法》的有关规定,继续开展著名商标认定工作。新认定南京市著名商标32件,并对到期的74件市著名商标进行了重新认定。全市有18件商标被江苏省工商局新认定为省著名商标,到期的48件省著名商标江苏省工商局进行了再认定。2004年全市新增注册商标5000件,同比增长18%,注册商标总数达30000件。
    2004年,全市工商系统集中开展了三次专项整治行动。一是对食品、药品商标侵权行为开展了专项检查;二是对侵犯驰名商标、著名商标专用权行为开展了专项检查。对中国粮油进出口公司在葡萄酒上注册的“长城”商标进行了专项保护,捣毁制假窝点1个,罚没款6万元;三是对有侵权行为的印制企业进行了专项检查。据不完全统计,2004年,全市工商系统共出动执法人员3000多人次、汽车500多辆;检查经营户3000户;各类市场、药店2000多个;捣毁制假窝点6个;查处商标违法案件138件,其中涉外商标侵权案件4件;没收侵权商标标识18340件(套);销毁没收侵权商品26吨;罚没款总数达320.5万元。

    南京市高度重视版权保护工作,2004年11月市政府办公厅印发了《关于使用正版软件的通知》,要求市及区县党政机关限时清理盗版软件,使用正版软件。市版权局完成了各单位使用软件情况调查,为全面完成党政机关使用软件正版化奠定了基础。
市版权局大力推进软件正版化行动。从3月份开始,要求全市勘察设计行业各单位清理并删除盗版软件,尽快制定使用正版软件的计划,此举引起全行业重视,大多数单位进行了认真的自查并拟定出整改计划。
    5月份,市版权局召开企业使用软件情况研讨会,一些企业在会上介绍了对使用正版软件的认识过程,加深了对《著作权法》和《计算机软件保护条例》的理解,提高了使用正版软件的自觉性,尚未使用正版软件的企业,也提高了认识,认为维护企业的信誉,必须遵守“游戏规则”,使用正版软件。
    为宣传、普及著作权法,市版权局在3月份组织了全市新闻出版单位参加了国家版权局主办的“全国著作权知识大赛”,提高了新闻出版从业人员的版权保护意识。
    全年开展了对盗版软件、音像制品及教材教辅图书专项治理20多次,共出动执法人员21万人次,检查各类出版物市场、经营点1.9万家次,端掉非法出版物地下批销窝点68个,收缴各类非法出版物270万张(册),其中盗版书刊14.8万册、盗版电子出版物及音像制品241万张。

    2004年,南京市中级人民法院共新收知识产权民事一审案件315件,其中专利权纠纷175件,著作权纠纷74件,商标权纠纷11件,植物新品种权纠纷12件,技术合同、不正当竞争等其他案件43件。审查诉前(中)临时措施申请6件,下达临时禁令裁定4件,采取诉前证据保全措施1件。全年结案355件,其中判决136件,调解和撤诉210件,移送9件。知识产权案件的类型几乎覆盖了Trips协议规定的所有领域。
    全市法院还加强了对知识产权犯罪活动的打击力度,受理涉及知识产权的刑事案件18件37人,其中生产销售伪劣产品罪8件18人,非法经营罪8件14人,侵犯著作权罪1件4人,侵犯商业秘密罪1件1人,均作了有罪判决,并处罚金1477万余元。其中,被告人钟山等侵犯著作权、非法经营案一审判处的罚金达1300万元,没收财产100万元,被评为2004年度中国知识产权保护十大案例。
    根据最高人民法院《关于进一步加强知识产权司法保护工作的通知》,南京市中级人民法院积极适用相关法律,果断采取诉前(中)停止侵犯知识产权行为措施和证据保全、财产保全手段,严厉制裁违反临时措施的当事人,对于情节严重的侵权行为,除依法判决侵权人承担民事责任外,还视具体情况给予民事制裁,为知识产权专项行动的深入开展提供了有力的司法保障。全年司法拘留1人,罚款2人17万元,采取证据保全51件,财产保全36件,查封、扣押财产938.7万元。
    2004年,南京市中级人民法院成功审理了一批在省内外有重要影响的复杂、疑难案件,如金箔集团、青岛海尔、广东科龙、四川长虹、江苏恒顺、郑州宇通、常柴股份、山东澄海、第29届奥林匹克运动会组织委员会等涉诉案件,在知识产权权利冲突、药品知识产权保护、网络著作权侵权判定、外观设计近似性判断、临时措施、间接侵权认定、等同原则适用、侵权物品的处理等方面大胆进行实践,有效实现了办案法律效果和社会效果的统一,赢得了国内外众多企业的信任。

    2004年,南京市公安局坚决打击侵犯知识产权违法犯罪,切实保护权利人合法权益,侦办了一批侵犯知识产权犯罪案件,有力地打击了违法犯罪分子的嚣张气焰。全年共查处制黄贩黄、侵权盗版案件160余起,其中侵犯知识产权的刑事案件28起,抓获违法犯罪嫌疑人员200余名,依法打击处理123人,其中逮捕8人,劳教4人,治安处罚111人;收缴盗版淫秽光盘18万余盘。
    一是精心组织开展打击侵犯知识产权犯罪专项行动,重点打击了侵犯食品、卫生生活用品、药品、农资等商品的商标专用权,严重危害人民群众身体健康、生命安全和生产安全,以及国内知名企业和外商投资企业反映强烈、情节严重、影响恶劣的重大侵权犯罪案件。行动期间,全市公安机关破大案、抓现行、捣团伙,保护了知识产权,规范了市场秩序。2004年11月,南京市公安局针对知名企业商标频遭侵权的现状,开展了打击侵犯商标专用权犯罪的“山鹰”行动。在专项行动中,共破获侵犯知识产权犯罪案件21起,抓获犯罪嫌疑人29名,挽回经济损失3800余万元。
    二是重点侦破了一批有影响的侵犯知识产权案件。下关公安分局破获了犯罪嫌疑人郭某非法销售假冒注册商标的“海飞丝”、“飘柔”、“潘婷”等洗发、护发用品,价值达 24万余元案件。玄武公安分局破获了原远志公司销售副总经理沈某、高级研发主管吴某等人,窃取还原卡产品源代码案件。南京市公安局经侦支队成功侦破了邦德润滑油有限公司假冒金城集团注册商标一案,涉嫌侵权公司的两名负责人被批准逮捕。
    三是加强面上查禁打击行动。全年共出动警力2200余人次,捣毁制售盗版光碟窝点39处。9月,市公安局治安部门会同省市工商、文化以及市扫黄打非办公室组成联合检查组,对珠江路地区电脑光盘批发市场、鼓楼长三角书市及其它的重点书刊、音像、软件市场进行了全面检查,共收缴盗版书刊900余本,非法音像制品550张,盗版软件62套,以及盗版音像制品2600余盘。

    在全面推进和完善南京关区知识产权海关保护工作机制的基础上,2004年,南京海关认真研究知识产权海关保护工作中出现的新情况、新问题,积极扩大对外宣传和交流,依法查处侵权案件,知识产权保护工作成效显著。
    2004年,南京海关共查获侵权案件51起,案值达592万元人民币,案件数和案值数比上年分别增长230%和150%。51起侵权案件中,侵犯商标专用权案件36起、专利侵权案件2起、侵犯著作权的盗版光碟案件13起。货运渠道发现侵权嫌疑16起,立案查处5起,案值262万元人民币,主要侵权货物为金属卤化灯、竹编地毯、油墨、门锁等;行邮渠道发现侵权嫌疑案件35起,主要是包、鞋、盗版光碟等。其中出口侵犯专利权的竹编地毯,货值达95万元人民币,为南京关区查获案值最大的一起知识产权侵权案件。南京海关查处的某省某公司出口运动鞋侵犯耐克公司商标权案,被中国外商投资企业协会优质品牌保护委员会评为全国十佳“2003-2004年度最佳案例”之一。
    为提升海关关员知识产权保护意识和执法水平,召开了“关区知识产权海关保护工作会议”,先后开展了不同层次、多种形式的培训和交流活动。举办了《知识产权海关保护条例》培训班、关区行邮渠道知识产权保护培训,邀请权利人共同参与对现场关员进行知识产权保护知识讲座、特邀德国阿迪达斯、德国戴姆勒?克莱斯勒、美国通用汽车、法国欧莱雅、瑞士罗技电子等公司介绍其品牌产品真伪查验及鉴别方法等,增强了一线工作人员鉴别商标真伪的能力,提高了侵权货物的查获率。

The year of 2004 witnessed a full development of intellectual property undertakings in Nanjing. With enforcement of intellectual property protection as priority and conduction of specialized operations for protection of intellectual property as moment, Nanjing concentrated on the construction of a sound legal system and protection environment for intellectual property and on the establishment of regulating mechanism over intellectual property. This played a very important role in stimulating the development of science, economy and full-scale social progress.

Part One

Nanjing Municipal People’s Government greatly pushed forward the intellectual property protection work. At the beginning of 2004, Nanjing municipality placed intellectual property work into the goal of the whole city’s economic construction and social development. Vice Mayor Xu Huiling signed the annual targeted responsibilities for patent work with each district (or county) of Nanjing municipality, high-tech development zone and industrial group. In the same year, Nanjing municipality adjusted the member units of the Joint Meetings on Intellectual Property, with a total number of members and associated members reaching 24; drafted “The 3-Year Plan (Draft) of Intellectual Property Protection in Nanjing, 2003”; published abroad, for the first time, the white paper “Protection on Intellectual property in Nanjing, 2003”; passed inspections on the national pilot city’s patent work; and was listed into the national intellectual property pilot city. In 2004, 5 districts (or counties) were consequently listed into the provincial pilot site of intellectual property, 3 of them passed inspections in due time and 1 was approved to be the demonstration district of intellectual property in Jiangsu province.
On “April 26, the World Intellectual Property Day”, Nanjing municipality held joint meetings on intellectual property. Jiangsu Provincial Intellectual Property Bureau (JPIPB) and Jiangsu Higher People’s Court jointly held “Jiangsu Intellectual Property Forum” in Nanjing, with the theme of “Encouraging Knowledge Innovation and Protecting Intellectual property”. Vice Mayor Xu Huiling made a speech on strengthening protection of intellectual property in central cities. During this period, JPIPB and Nanjing Municipal Intellectual Property Bureau (NMIPB) carried out series of activities on promotion and consultation of intellectual property in the Gulou Square jointly with relative departments, such as, Nanjing Municipal Industry & Commerce Administration (NMICA), Nanjing Municipal Copyright Bureau (NMCB), Nanjing Municipal Public Security Bureau (NMPSB), Nanjing Customs and Nanjing Municipal Pornography & Piracy Control Office (NMPPCO) and some patent agencies. And each district (or county) also carried out relative activities. In May, Vice Mayor Xu Huiling received the visiting delegation composed of members from Hong Kong Intellectual Property Office,Hong Kong Labor Union of Trademark Professionals and the Asia Patent Agent Association, and exchanged ideas in strengthening the cooperation in intellectual property protection. The visiting group held “Jiangsu-Hong Kong Intellectual Property Protection Seminar” with JPIPB. From September 2004, Nanjing conducted specialized operations for protection of intellectual property. The General Office of Nanjing Municipality issued “The Implementation Plan of Specialized Operations for Intellectual Property Protection, Nanjing”.

Part Two

In 2004, patent applications increased tremendously, reaching 3908, an increase of 26.6% over last year. Among them, 1414 were patents of inventions; 1422, of practical new types; and 1072, of shape designs. The number of invention patent applications maintained in the leading position in Jiangsu province. 1883 patents were authorized in 2004, in which, 474 were patents of inventions; 922, of practical new types; and 487, of shape designs. The patent work made larger progress in some districts and counties of Nanjing. Among the 3 counties (or cities) in Jiangsu province, each with over 800 patent applications, Xuanwu and Gulou districts ranked the 2nd and the 3rd with respectively 945 and 818 patent applications. Among the top 10 universities in regard with the quantity of patent application in the province, 8 ones were from Nanjing. While Nanjing University and Southeast University respectively ranked the 8th and the 9th among all the universities and colleges in China in regard with their patent application quantity, and the 7th and the 13th in regard with their applications for patent of invention; some enterprises ascended to the national top 100 or the provincial top 10 in regard with their own application quantity. Patent agencies also experienced growth. Now there are 10 patent agencies in Nanjing, 4 of them were certified by the National Intellectual Property Bureau to serve foreign clients. These patent agencies surrogated 4682 patent applications, and 3534 of them were from Nanjing, accounting 75% of the total.
Nanjing municipality strengthened direction and support for patent implementation, laying priority to the fields of electronic information, automobile manufacture, biomedical technology, environment protection, modern agricultural, new materials and new energies, with 6 million RMB science fund in 3 categories from the government and with programs targeted for key patents or second stage patent development. At the same time, the municipality also guided enterprises to establish the corresponding management system. There are 68 enterprises and institutions in the city listed into the “Program of Promoting Intellectual Property Administration over Enterprises and Institutions in Jiangsu Province” and the “Program of Intellectual Property Strategy over Key Enterprises and Industries in Jiangsu Province”.
In 2004, patent administration and law execution were further enforced. The Joint Law Execution Group, jointly organized by JPIPB (Jiangsu Provincial Intellectual Property Bureau), NMIPB (Nanjing Municipal Intellectual Property Bureau) and related district intellectual property administration departments, inspected more than 10 emporiums and pharmacies and over 200 brands of merchandises, handled 3 cases of patent infringement and settled 4 disputes over patent right.

Part Three

In 2004, NMICA (Nanjing Municipal Industry & Commerce Administration) continuously carried out authentications on famous trademarks in accordance with “Measures of Authentication & Protection of Famous Trademarks, Nanjing”, authenticated 32 as famous trademark of Nanjing, and reauthenticated 74 mature famous trademarks. 18 Nanjing’s trademarks were authenticated by JPICA (Jiangsu Provincial Industry & Commerce Administration) as famous trademark of Jiangsu province, and 48 mature ones were reauthenticated. In 2004, 5000 new trademarks were registered, an increase of 18% over last year, the total number of registered trademarks reached 30000.
In 2004, Nanjing industry and commerce departments carried out 3 concentrated specialized operations of rectification. The first one was a specialized inspection over violations against food and drug trademarks. The second was the specialized inspection over violations against famous trademarks or exclusive rights over famous trademarks. The operations provided special protection for the trademark “the Great Wall” registered on wines by China Cereal, Oil Import & Export Corporation and destroyed a fake site with a penalty and confiscation accounting for 60,000 RMB. The third was the specialized inspection over printing businesses involved in infringement. According to incomplete statistics, in 2004, Nanjing industry and commerce departments dispatched 3000 people and 500 vehicles for the specialized operations, inspected 3000 businesses, 2000 markets and pharmacies, destroyed 6 fake sites, handled 138 trademark violation cases in which, 4 foreign cases, confiscated 18,340 infringement trademarks, destroyed 26 tons of infringement merchandise, fined and confiscated 3.205 million RMB.

Part Four

Nanjing municipality put great importance to copyright protection, the General Office of Nanjing Municipality issued “Notice on Utilization of Copyrighted Software” in November, 2004, requesting each party and government organization to clear the illegal software within regulated time and to use copyrighted software. NMCA (Nanjing Municipal Copyright Administration) made investigations of software utilization in all units, laying the groundwork for all party and government organizations’ utilization of copyrighted software.
NMCA made great efforts for utilization of copyrighted software. In March, they requested all units in survey and design industries to remove all illegal software and use copyrighted one within regulated time and to make a plan of replacement with copyrighted software. This attracted much attention from all units in these industries. Most of them inspected their own condition and made replacement plans.
In May, NMCA held seminars on utilization of software in enterprises. Some introduced their understanding process of utilization of copyrighted software in the seminars. Through the seminars, the participants deepened their understanding of “Copyright Law” and “Regulations on Computer Software Protection” and improved their consciousness of using copyrighted software. Those enterprises that had not yet used copyrighted software also improved their understanding in this regard, and believed that in order to uphold the reputation of their business, they must follow “the rules of the game”, utilize copyrighted software.
In March, in order to rouse the awareness of the Copyright Law, NMCA organized all the press and publication units to participate the “National Competition of Copyright Knowledge” held by the National Copyright Administration in March. This raised the consciousness of copyright protection of all the people working in this field.
During this year, over 20 specialized operations were taken against piracies in software, audio-visual products, textbooks and tutorial books; about 210,000 staffs were sent out; 19,000 publication markets and shops inspected; 68 illegal publication wholesale sites destroyed; and nearly 2.7 million illegal publications confiscated, of which, 14,8000 were pirated books or periodicals and 2.41 million, pirated electronic publications.

Part Five

In 2004, Nanjing Municipal Intermediate People’s Court (NMIPC) received 315 new civil cases concerning intellectual property. Among them, 175 were disputes over patent rights; 74, disputes over copyrights; 11, over trademark ownership, 12, over new kind of plants ownership; and 43 cases of others, such as, technology contracts and unfair competition. NMIPC examined 6 cases of application for temporary measures before (and during) lawsuits, issued temporary prohibitions for 4 cases and maintained evidence for 1 case before hearing. During the year, NMIPC settled 355 cases, where 136 of them were brought in verdict, 210 mediated and withdrawn and 9 transferred. The cases related to intellectual property covered all areas that TRIPS has defined.
All the courts in Nanjing also reinforced fighting against crimes concerning intellectual property and settled 18 criminal cases related to intellectual property with 37 offenders. Among them, 8 cases involved in manufacturing and selling fakes with 18 offenders; another 8 involved in illegal operation of business with 14 offenders, 1 involved in copyright violation with 4 offenders; and another 1 involved in business secret violation with 1 offender. All these cases were sentenced guilty and the total penalty reached about 14.77 million RMB. In one of these cases, the defendant Zhong Shan and his partners involved in copyright violation and illegal operation of business was fined 13 million RMB at the first sentence and confiscated 1 million RMB. This case was listed into the 10 major cases in the protection of intellectual property in China, in 2004.
According to the “Notice of Further Strengthening the Judicial Protection of Intellectual property” issued by the Supreme People’s Court, NMIPC quoted relative laws and regulations and actively adopted measures to stop violations against intellectual property and to maintain evidence and properties before (and during) lawsuits. NMIPC gave serious punishment to those violating temporary measures. As for some serious infringement of intellectual property, NMIPC not only ordered offenders to fulfill civil responsibilities in accordance with laws but also gave them necessary punishment in accordance to specific condition. Thus NMIPC provided sound judicial support for the specialized operations taken for protection of intellectual property. In the year, 1 offender was detained; 2 offenders were fined 170,000 RMB; 51 cases were decided to maintain evidences; 36 to maintain properties; and 9.387 million RMB worth of properties sealed up and detained.
In 2004, NMIPC successfully adjudicated a number of complicated and difficult cases with influence in and out of Jiangsu province, such as, cases involving Gold Foil Group, Qingdao Haier Group, Guangdong Kelon, Sichuan Changhong Electronic Group Co., Ltd, Jiangsu Hengshun Group Company, Zhengzhou Yutong Group, Changchai Co., Ltd, Shandong Chenghai and the Organizing Committee of the 29th Olympic Games. NMIPC made bold practices in handling intellectual property conflicts, protection of intellectual property over drugs, identification on network copyright infringement, identification on similarity in shape design, provisional measures, identification of indirect infringement, application of equal principle, and handling of infringement articles. NMIPC successfully unified the effects of laws in case handling with positive social effects and won the trust of many businesses both at home and abroad.

Part Six

In 2004, NMPSB (Nanjing Municipal Public Security Bureau) fought firmly against crimes violating intellectual property, positively protected legal rights and interests of owners, investigated and solved a number of cases violating intellectual property and effectively defeated the criminals. During the year, they investigated and handled over 160 cases involved in piracy, infringement and producing and selling of pornography, 28 of them were criminal cases violating intellectual property; arrested about 200 suspects; punished 123 offenders according to laws, 8 of them arrested, 4 labor educated and 111 punished according to public security regulations; and confiscated more than 180,000 pornographic CDs.
Firstly, NMPSB carefully planned and conducted specialized operation against crimes violating intellectual property, laying priority to the crimes violating the exclusive right over trademark in the fields of food, daily sanitary articles, medicines and farming materials and to the crimes threatening people’s health, life and production as well as to the crimes loudly complained by well known domestic companies and foreign investment companies. During the operation, Nanjing municipal public security departments investigated and solved major cases, caught criminal’s blood in hand, destroyed criminal gangsters, protected intellectual property and straightened order of markets. In November, 2004, NMPSB carried out “Mountain Eagle” operation against violations of exclusive right over trademarks that frequently occurred. In this operation, NMPSB solved 21 criminal cases violating intellectual property, arrested 21 suspects and saved 38 million RMB worth of economic losses.
Secondly, NMPSB investigated and solved a number of widely influenced cases violating intellectual property. NMPSB, Xiaguan Branch solved a case of illegal selling of fake shampoo and hair care products violating trademarks like “Head & Shoulders”, “Rejoice” and “Pantene”, the total value was about 240,000 RMB. NMPSB, Xuanwu Branch solved a case in which Shen, the former vice general manager of sales of Yuanzhi Company, and Wu, the former senior R& D in-charge of Yuanzhi Co. Ltd, stole the source code of backup card. The Economic Cases Detachment of NMPSB successfully solved a case in which the Bond Lubrication Co., Ltd. violated the trademark of Jincheng Group, 2 persons in-charge involved in this case were arrested.
Thirdly, NMPSB strengthened operations on over all investigation and prohibition. In the year, 2200 personnel were sent out, 39 sites of manufacturing and selling of pirated CDs were destroyed. In September, NMPSB set up the Joint Inspection Group with both provincial and municipal level industry and commerce administrations, cultural bureaus and pornography and piracy control offices, made a thorough inspection on CD wholesale market in Zhujiang Road, Gulou Triangle Book Market and other key book, audio-visual and software markets and seized about 900 pirated books and periodicals, 550 illegal audio-visual products, 62 set of pirated software and over 2600 pirated audio-visual products.

In 2004, on the basis of perfecting the working mechanism of the customs protection over intellectual property in Nanjing Customs region, Nanjing Customs carefully studied new problems and circumstances occurred in the customs protection over intellectual property, actively roused the awareness of public, exchanged ideas with others, investigated and solved violation cases according to laws, and made significant progress in protection of intellectual property.
In 2004, Nanjing Customs investigated and found 51 violation cases with a total value of 5.92 million RMB, an increase of 230% and 150% respectively over last year. Among the 51 cases, 36 involved in trademark infringement, 2 involved in patent infringement and 13 involved in copyright violation with pirated CDs. In freight transportation channels, 16 cases of suspected infringement were found and 5 of them, with a total value of 2.62 million RMB, were placed for investigation and solved. The main items of these cases were found to be metal-halide lamps, bamboo-weaved carpets, printing ink and locks. In the post channels, 35 cases of suspected infringement were found and the main items of those cases were bags, shoes, pirated CDs. The case of bamboo-weaved carpets to be exported, violating patent right with a total value reaching 950,000 RMB, was the biggest case in value found in Nanjing Customs region. Another case, offended by a company from some other province, violating the trademark of Nike Sports Shoe Company handled by Nanjing Customs was listed into national top 10 of “ Best Cases from 2003-2004” by the Fine Brands Protection Committee of China Association of Foreign Investment Businesses.
In order to raise the intellectual property protection consciousness and law execution standard of custom officials, “Working Conference on Customs Protection of Intellectual property in Customs Region” was held, and trainings and exchanges of various forms at different levels were conducted after the conference. Trainings on “The Customs Protection Regulations over Intellectual property” and on the protection of intellectual property in post channels in customs regions were also held. Intellectual property owners were invited to attend intellectual property protection courses delivered to the customs officials. Some famous companies such as Adidas (Germany), DaimlerChrysler (Germany), General Motors Corporation (USA), L'OREAL (French) and Logitech (Switzerland) were specially invited to introduce the method on identification of their products. All these helped customs officials in identification of trademarks and increased their success in identification of infringement.
