2007 年， 南京市知识产权工作在市委、市政府的领导下， 从落实科学发展观和构建和谐社会的高度出发，充分发挥政府职能作用，坚持“宣传教育提高全民意识，强化执法净化市场环境”工作思路，围绕“知识产权文化年”建设目标，认真开展知识产权宣传教育培训，严厉查处知识产权严重侵权犯罪案件，集中整治市场秩序， 进一步加大保护知识产权力度， 营造我市良好的经济和社会发展环境和法治环境，不断提高企事业单位知识产权创造、管理、保护和运用能力，知识产权事业发展迅速。

（一）

    2007 年我市知识产权工作部门积极配合，各司其职，全市知识产权保护能力和执法水平均取得了显著进步。一是在知识产权创造方面，突出企业主体地位，加强申请 专利和商标注册。 2007 年 全市专利申请总 量达 8030 件， 同比增长 18.24% ，其中发明专利 3410 件，同比增长 1.55% ，实用新型 2295 件，同比增长 14.59% ，外观设计 2325 件，同比增长 62.54% 。 新认定南京市著名商标 62 件，共有 34 件商标被江苏省工商局新认定为江苏省著名商标，新增驰名商标 9 件。目前，全市拥有各类注册商标总数达 4 万余件，驰名商标 16 件，江苏省著名商标 162 件，南京市著名商标 302 件。二是知识产权保护方面，采取持续不断的查处和整治。 全市全年接受举报投诉专利纠纷案件 9 件，立案 7 件，审理 9 件，中止 4 件，结案 9 件； 立案查处商标违法案件 130 件，罚没金额 415.9 万元；查处 18 个网络侵权案件，删除侵权内容，关闭侵权网站，没收侵权服务器；法院 新收知识产权民事案件 468 件，涉案标的额 1.57 亿元， 审结案件 462 件，其中判决结案 130 件，调解结案 31 件，撤诉结案 276 件，其他 25 件 。 调解、撤诉率达 68% 。 已结案件中， 没有再审案件 。 全年判决赔偿原告经济损失近千万元； 全市公安机关共破获侵犯知识产权犯罪案件 301 起，涉案金额 6800 万元， 先后收缴非法侵权盗版光盘 55 万余张，书刊 3600 余册，抓获犯罪嫌疑人 374 名，刑拘 157 人，逮捕、直诉、劳教 53 人；南京地区各海关、单位共查获各类进出境侵犯知识产权案件 15 起，查获侵权货物物品数量 12812 个（件），案值人民币 18 万余元。三是在 规章 制度建设方面，强化政府扶持引导作用。 新出台了 《南京市知识产权示范企业培育指导意见》、 《南京市优秀专利奖评选办法》、 《南京市知识产权诉讼法律援助办法》、《在科技管理工作中建立专利审查制度实施意见》等一批促进和保护知识产权的地方政府规章。四是在知识产权保护宣传方面，以“ 4.26 ” 知识产权宣传周为主平台， 开展了“知识产权走进高校院所”巡回宣讲、新街口商圈“重点商品知识产权备案查询系统”开通仪式、“劳动者之声”主题歌会暨 4.26 世界知识产权日纪念大会等十多场大型知识产权宣传咨询活动， 利用电视、广播、报纸等主流媒体开展了形式多样的系列宣传 ， 营造全市知识产权保护氛围，提高全民意识。五是在 完善 知识产权保护 服务机制方面。 2007 年 6 月 1 日 ，由南京市司法局、南京市知识产权局、南京市科协联手在省内率先建立了“南京市知识产权诉讼法律援助中心”，出台了《南京市知识产权诉讼法律援助办法》。加强服务外包中知识产权保护工作。 在市层面建立服务外包知识产权保护投诉中心；在“中国服务外包基地城市”的五个示范区分别建立软件外包知识产权保护投诉分中心。

（二）

    2007 年，全市专利保护工作，市知识产权局充分发挥区县专利管理部门职能作用，积极指导、帮助企事业单位建立专利保护管理体制，加大专利侵权的打击力度，确保全市专利工作呈现协调、稳步的发展局面 。

    专利申请的数量和质量均保持快速增长的趋势 。 2007 年全市专利申请总量达 8030 件，同比增长 18.24% ，其中发明专利 3410 件，同比增长 1.55% ，实用新型 2295 件，同比增长 14.59% ，外观设计 2325 件，同比增长 62.54% 。

    积极调解专利纠纷。全年接受举报投诉专利纠纷案件 9 件，立案 7 件，审理 9 件，中止 4 件，结案 9 件。

    抓好对流通市场的专利产品销售检查。 4 月 6 日 省、市、区联合在高淳县开展的专利行政执法活动，对高淳县百货大厦有限公司、人民商场有限公司两家省级认定的无假冒专利商场进行专利执法检查，并对查出的有关问题进行现场纠正。 4 月 20 日 及 11 月 3 日 ，省、市、区知识产权局再次联手在我市主城区新街口商圈及欧尚超市开展了二次专利行政执法活动，在严格检查侵犯知识产权违法行为的同时，不失时机地向商场营业人员和消费者宣传知识产权知识。两次执法活动共检查商品 400 余件，涉嫌冒充专利的有 6 个商品， 均按行政执法程序依法处理 。 全年共 对 中央商场等 5 个商场 开展了 3 次专利行政执法检查，有效地维护消费者的合法权益。

（三）

    2007 年 , 市工商局以推进商标战略的实施为契机，进一步加大商标专用权的保护力度，深入开展了 “重点保护驰名商标和涉外商标专用权专项整治行动”、查处“ 侵权‘蓝带'（啤酒） 商标专用权专项整治行动” 、“华东六省一市商标重点保护行动”、“消费放心、红盾维权”商标保护专项整治行动”、和“保护奥林匹克标志专有权行动”以及对全市印制企业专项检查等六项专项执法行动，重点查处驰名商标、涉外商标、药品商标、农副产品商标、地理标志以及奥林匹克标识的假冒侵权案件，严厉打击非法印制和销售侵权假冒商标标识的行为，保护了消费者和商标所有人的合法权益。在专项执法活动中，全市工商系统共出动执法人员 5000 多人次，检查经营户 2.6 多万户；检查超市、药店、商品交易市场 1800 多家；共立案查处商标违法案件 130 件，罚没金额 415.9 万元。

    市工商局根据《南京市著名商标认定和保护办法》的有关规定，继续开展著名商标认定工作， 2007 年新认定南京市著名商标 62 件，并对有效期满的 95 件市著名商标进行了重新认定； 2007 年全市共有 34 件商标被江苏省工商局新认定为江苏省著名商标，有效期满的 58 件省著名商标由江苏省工商局进行了重新认定；新增驰名商标 9 件（“雨润”、“宝宝金水”、“宏图”、“南瑞”、“宏图三胞”、“金盛”、“红宝丽”、“海尔曼斯”、“英太青”）。目前，全市拥有各类注册商标总数达 4 万余件，驰名商标 16 件， 江苏省著名商标 162 件，南京市著名商标 302 件。

（四）

    加强版权保护是我市知识产权保护的重要内容，积极开展正版软件使用推进工作，着力打击网络侵权，销毁非法出版物等行动。

    市版权局在全面完成了政府软件正版化任务后，将软件正版化工作深入延伸，在全市推进企业软件正版化。专题举办了两期针对企业负责人“软件使用正版化”培训班，确定了首批正版化企业。通过宣传教育培训、企业自查自纠、主管部门进企业上门了解调查核实、验收等手段，深入推进企业软件使用正版化工作，现已有 21 家企业顺利完成了第一批正版化验收工作，第二批有 20 家企业上报正版化验收。

    开展了打击网络侵权专项整治行动。 2007 年，市版权局与市公安、电信等部门通力合作，共查处 18 个网络侵权案件，删除了侵权内容，关闭了侵权网站，没收了侵权服务器，有效地打击了网络侵权行为。

    开展了打击侵权盗版行动。 2007 年， 全市各版权行政管理部门及成员单位共出动行政执法人员约 19199 人次，检查各类出版物经营摊点 16809 家次，捣毁非法出版物地下批销窝点 173 个，收缴各类非法出版物 138.8 余万册（张），包括非法书刊、杂志 9.7 余万册，盗版音像制品和非法电子出版物约 119.7 余万张 ( 盘 ) ，共销毁各类侵权盗版出版物 170 余万件。同时出具各类鉴定书 36 份，鉴定出版物 9055 种，计 226923 盘（册）。

    严厉查处严重违法行为 。 2007 年，轰动全国的“ 7.7 ” 盗版图书批销案和“ 6.18 ”特大盗版图书案先后宣判。两起案件的罪犯均被处以刑事处罚。针对违法销售侵权出版物的行为判处刑罚处罚在全国尚属首例。 10 月份，根据举报，又破获一起批发盗版音乐教材案，收缴盗版教材 1 万余册。同时查获 两家利用网络经销盗版图书的窝点，当场查获了大量待售的盗版书籍，以及自行刻录的 2000 余盘盗版教辅光盘。

    对全市音像市场进行集中整治。 2007 年春节前后，市“扫黄打非”办先后联合公安、文化、市容等部门对销售盗版光盘现象较严重的珠江路、马台街等地段连续开展了 5 次大规模集中行动。各部门共出动检查人员 500 多人次，检查音像店和摊点 50 余家，收缴各类非法电子音像制品和盗版软件 30 余万张。

    对侵权出版物进行了集中销毁。 2007 年 4 月 14 日 上午 ，江苏省和南京市“扫黄打非”办，在南京河西新城南苑地区举行“ 2007 年全国‘扫黄打非'春季战役非法出版物集中销毁活动江苏省暨南京市现场会”。此次行动，共销毁各类非法出版物 263 万件，其中我市销毁约 170 余万件。

    举办了“版权在我心中”征文活动。版权局与教育局、知识产权局、《好家长》杂志社联合开展了“版权在我心中”征文活动，活动持续五个月，有 100 余所学校参加，收到征文 25805 篇。通过专家评选出 154 篇优秀征文。其中一等奖 11 篇，二等奖 41 篇，三等奖 102 篇。《中国新闻出版报》以两个整版的篇幅全文刊出了 11 篇优秀征文。此项活动在中小学生中产生了极大的影响，版权保护意识逐步深入人心。

    开展了大规模的“ 4.26 ”世界知识产权日宣传，共组织八项活动。与玄武区知识产权局、区文化局、江苏连邦等部门和单位联合在珠江路广场开展了知识产权宣传活动；与鼓楼区文化局、北京金山软件公司在山西路市民广场共同举办了大型宣传活动；与建邺区文化局在金盛国际家居广场举行了宣传咨询服务；与市版权保护协会共同组建了全国第一支版权保护监督员队伍，并进行了专业知识培训。

（五）

    2007 年，南京市中级人民法院充分发挥知识产权审判在保护创新、建设创新型国家和社会 中的地位和作用， 坚持公正、高效、权威的知识产权审判制度， 努力实现法律效果与社会效果的统一 。

    全院全年新收知识产权民事案件 468 件，涉案标的额 1.57 亿元，其中专利权纠纷 245 件，著作权纠纷 141 件，商标权纠纷 41 件，技术合同纠纷 19 件，不正当竞争纠纷 17 件，植物新品种权纠纷 5 件。 涉及南京地区当事人的达到 273 件，占总数的 58% ，同比增长近 80% ； 全年新收知识产权涉外案件 17 件，涉及德国、法国、美国、瑞典、加拿大、约旦、日本、中国香港等 8 个国家和地区，其中专利权纠纷 12 件，商标权纠纷 2 件，不正当竞争纠纷 2 件，著作权纠纷 1 件。受理的案件中，新类型案件越来越多，包括请求确认不侵犯专利权案件 19 件，请求确认不侵犯商标权案件 1 件，网络域名纠纷 1 件，与知识产权有关的损害赔偿案件 1 件，请求认定驰名商标案件 7 件。

    全年共审结案件 462 件，其中判决结案 130 件，调解结案 31 件，撤诉结案 276 件，其他 25 件 。 调解、撤诉率达 68% 。 已结案件中， 没有再审案件 。 全年判决赔偿原告经济损失近千万元。

    2007 年，全市法院一审审结侵犯著作权、侵犯商业秘密、假冒注册商标等涉及知识产权类犯罪案件 14 件 30 人，其中假冒注册商标罪案 1 件 1 人，销售假冒注册商标的商品罪案 2 件 2 人，侵犯著作权罪案 9 件 22 人，侵犯商业秘密罪案 2 件 5 人。二审审结 侵犯著作权犯罪案 2 件 11 人。在陈和忠等侵犯著作权犯罪一案中，被告行为造成了较为恶劣的社会影响，法院对该涉案 10 人作出有罪判决，罚金 50.5 万元，对 涉案的盗版、淫秽光碟予以没收， 有力发挥了刑事审判的司法保护作用。

    2007 年，全市法院 继续加大对知识产权司法保护力度， 积极采取 依职权取证措施和财产保全措施。 全年共采取证据保全措施 57 次，财产保全措施 64 次。 充分发挥民事制裁在知识产权诉讼中的特殊作用 。 继续发挥司法调解工作在知识产权审判中的重要作用， 注重引导知识产权向社会生产力转化，使发明创造作为社会财富的价值得到充分实现。 一批在本地区乃至国际上有影响的知名品牌企业的案件，如 “宝宝金水”、“宏图三胞”、“弓箭国际”、“南汽”等案件以调解结案，达到当事人双赢、社会多赢的良好效果。

    在认真做好案件审判的同时，不断扩大司法审判的透明度。通过新闻发布会、公开庭审、裁判文书上网、声讯查询等方式公开与知识产权审判有关的信息。全年 公布了上年度十个知识产权典型案例， 向人大、政协等部门 推荐旁听庭审案件 ，通过《知识产权报》公开开庭信息，在《中国知识产权裁判文书网》上公开生效裁判文书 388 篇， 利用审判信息声讯查询系统，向一般公众、案件当事人提供案件相关信息， 全面接受权力机关和社会各界对知识产权司法的监督。

    对知识产权司法保护中出现的新问题大胆探索，尝试明确了知识产权行政处理程序与司法程序的管辖关系，探讨了对申请财产保全错误、申请诉前禁令错误的理解以及对相关损害赔偿范围的确定， 通过积极协调与沟通，保证关联案件司法尺度的统一。

    积极进行审判机制改革，优化配置知识产权审判资源。经申请， 玄武区、江宁区法院获得本辖区内部分知识产权民事一审案件的管辖权； 市中级人民法院及鼓楼区法院开始知识产权民事、刑事、行政审判“三审合一”的改革试点工作， 制定了《南京市中级人民法院关于知识产权民事、刑事、行政审判“三审合一”试点工作的实施意见》，建立比较合理的知识产权审判运行机制，促进了知识产权司法保护体制整体效能的有效发挥。

    2007 年，市公安局充分发挥职能作用，认真查处严重侵权犯罪案件，重拳打击知识产权犯罪行为，维护市场秩序。全年共破获侵犯知识产权犯罪案件 301 起，涉案金额 6800 万元， 先后收缴非法侵权盗版光盘 55 万余张，书刊 3600 余册，抓获犯罪嫌疑人 374 名，刑拘 157 人，逮捕、直诉、劳教 53 人。

    强化破案攻坚，侦破了一批有影响的案件。 公安机关把组织侦破大要案件作为震慑违法犯罪分子、遏制严重侵犯知识产权犯罪的有力武器，集中破获了一批手段新、金额大、破坏严重的案件。 市局治安支队在本市雨花区当场抓获正在装运假冒伪劣卷烟的犯罪嫌疑人顾某，共查获假冒伪劣卷烟 2 万余条，总价值 81 万元。 9 月 20 日 ，雨花分局抓获涉嫌销售假冒注册商标商品罪的犯罪嫌疑人朱某，经查犯罪嫌疑人朱某伙同他人，先后 18 次以现金交易方式销售给南京某酒业公司“洋河”蓝色经典系列酒货值 50 余万元，价格低于正常的批发价格，经厂家鉴定为假冒产品，朱某被依法刑事拘留。 2007 年 1 月至 4 月份，玄武分局抓获涉嫌非法经营犯罪嫌疑人李某。 2007 年 1 月份至 4 月份，李某伙同他人在福州市长期进行复制批发违法音像制品，涉及江苏、浙江、江西、上海等省份，数量达 100 余万张。该局还捣毁 1 个位于南京市珠江路某大型超市内大量长期销售假冒茅台酒的犯罪团伙，并抓获涉嫌销售假冒注册商标的商品犯罪嫌疑人吴某，该人多次向大型超市提供假冒著名茅台商标的白酒共计 420 箱进行销售，涉案总值 200 余万元。江宁分局抓获涉嫌侵犯商业秘密犯罪嫌疑人李某，李利用担任南京某光源有限公司外贸文员工作之便利，将公司的客户资料和经营信息私自复制，离开公司时将资料带走，后在网上设立网站，利用该光源公司的宣传资料进行宣传，销售同类产品，造成公司 100 余万元的经济损失。

    加强面上查禁整治，有效净化了知识产权市场环境。 全市公安机关会同有关行政执法部门，对掌握的重点线索及时梳理，组织力量突击检查，加大面上打击查禁力度。 期间， 会同文化、工商、新闻出版等相关主管部门，先后对我市对“珠江路电子一条街”、“长三角书刊批发市场”、“迈皋桥灯光夜市”等重点地区开展集中整治行动。全市各级公安机关共出动警力 3400 余人次，开展了“反盗版天天行动”、“卷烟打假集中整治行动”、“产品质量和食品安全专项整治”等专项行动，检查生产销售场所 800 余个，捣毁制、销假窝点 83 个，查获假冒伪劣产品总价值 2000 余万元，缴获制假生产工具设备 317 台。 4 月 15 日 ，下关分局在上海嘉定区一小区内查获假冒的“立邦”、“多乐士”等注册商标的乳胶漆空桶 3 万只，并抓获涉嫌销售假冒注册商标标识 的 网上在逃嫌疑人林某，经查 2006 年 9 月至 2007 年 4 月间，犯罪嫌疑人林某大量制造假冒“立邦”、“多乐士”、“中南”、“雅士利”等注册商标的乳胶漆空桶进行销售，非法经营额达 50 余万元。

    依托创平安企业保名牌活动，加大宣传防范力度。 公安机关积极策应全市“名牌战略”工作部署，对全市近 400 余家国家级、省级和市级名牌企业，包片负责，开展防遭外部侵害、防企业内部犯罪、防企业自身犯罪“三防”服务。依托省市重要媒体、公安网站以及图片集中展示等多种形式，及时披露已破获案件，提醒市民群众和社会各界加强对侵犯知识产权的防范，提高防范意识和能力。全市公安机关通过举办“打击经济犯罪成果巡展”，专题展示全市公安机关打击知识产权违法犯罪方面取得的成效，面对面与群众交流防范侵权犯罪的方法和技巧。公安经侦部门先后 3 次派员走进本市主要广播电台，以空中交流的形式将我市公安机关打击侵犯知识产权犯罪的情况向社会宣传，进一步提高群众的商标维权意识，做到全民发动，人人参与。中央电视台、《人民公安报》、《新华社每日电讯》、《新华日报》等中央及省市媒体也先后集中报道了我市公安经侦部门开展打击行动，以及开展案件查处情况，有力地提升了社会认知度以及企业、群众的信任度和满意度。

（七）

    南京海关以科学的治关理念为指导，认真履行知识产权海关保护职责，依法打击进出境侵犯知识产权的行为。 2007 年，南京地区各海关、单位共查获各类进出境侵犯知识产权案件 15 起，查获侵权货物物品数量 12812 个（件），案值人民币 18 万余元，依法保护了境内外权利人的合法权益，维护了进出境正常秩序和国家对外开放的良好形象。

    深入开展知识产权海关保护“龙舟”专项行动。 2007 年 10 月以来，南京海关根据海关总署统一部署，开展了知识产权保护“龙舟”专项行动。南京海关认真布置落实专项行动，务求取得实效，制定下发了《南京海关组织开展知识产权保护“龙舟行动”的工作方案》，对关区各海关单位开展“龙舟行动”进行周密部署，明确开展“龙舟行动”的范围、内容、要求和相关保障，确保专项行动的有序开展。关区各海关、单位紧密结合自己的工作实际，有针对性地制订了专项行动方案。

    加强对行 邮渠道的监管和查处。 南京海关驻邮局办事处加强对行邮快件渠道侵权行为的查处，根据行邮渠道今年侵权案件新的趋势，提高查验抽查比例，连续查获了多起出境邮寄侵权手表、饰品、剃须刀、手提包等案件，取得了实质性突破。

    突出货运渠道查处重点，严防侵权货物在南京口岸进出境。货运是货物进出口的主要渠道，南京新生圩港和禄口国际机场是南京市进出口海运和空运的主要口岸。南京新生圩海关和驻机场办事处在南京海关的统一领导下，增强知识产权保护意识，开展风险分析，加强对进出境知识产权特别是自主知识产权的保护力度，有效震慑了侵权行为的发生，取得了较好的成效。去年，新生圩海关在进出口监管中发现多起涉嫌侵犯知识产权案情，涉嫌侵权货物 17858 件，价值 197.6 万余元人民币，虽然后经联系权利人和其他因素排除了侵权嫌疑或没有启动海关保护程序而对涉嫌货物予以放行，但权利人对于海关依法主动保护其知识产权仍然表示赞赏和感谢，说明了海关对进出境知识产权保护的严格和认真。

    强化知识产权海关保护的宣传教育。南京海关增强服务观念和普法意识，通过南京海关关长专线，认真解答相关企业和个人对知识产权备案和知识产权海关保护方面法律法规的咨询。充分利用“ 4.26 保护知识产权法制宣传周”、“ 8.8 ”海关法制宣传日、“ 12.4 ”全国法制宣传日等重点主题宣传活动，集中力量、创新方式，广泛开展知识产权海关保护宣传教育活动，利用电视、报纸、网络、现场触摸屏等多种载体宣传知识产权海关保护的规定和作用，营造良好的知识产权保护氛围。江苏电视台、南京电视台、扬子晚报等多家新闻媒体采访和报道了南京海关驻邮局办事处开展知识产权保护“龙舟”行动并查获多起邮递快件渠道邮寄出境侵权假冒物品案件情况，起到了较好的宣传教育作用，进一步扩大了海关知识产权保护工作的影响。

    加强协作配合，形成知识产权保护执法合力。 2007 年南京海关继续注意加强与省、市知识产权主管部门联系，积极参与省、市知识产权保护协调部门组织的各项活动，主动加强与其他行政执法机关的协作配合。“ 4.26 ”知识产权保护宣传活动周期间，参加了南京市知识产权保护主管部门组织的系列宣传活动。 5 月，会同江苏省版权局、江苏省版权协会联合举办了进出口贸易中的著作权保护培训班，主要内容包括海关知识产权保护、进出口商品中的著作权保护及中介机构的作用等，增强了相关执法人员在进出口贸易中实施著作权保护的意识和能力。按照《最高人民法院、最高人民检察院关于办理侵犯知识产权刑事案件具体应用法律若干问题的解释》和《公安部、海关总署关于加强知识产权执法协作的暂行规定》，做好行政执法与刑事执法的衔接，全年依法向公安机关移交了 2 起行邮渠道查获的涉嫌侵犯知识产权的案件，增强了对侵权行为的震慑力。

State of Development and Protection of Intellectual Property of Nanjing City in Year 2007

    In the year 2007, CPC Municipal Committee and the Municipal government of Nanjing City, based on the principle of implementing Scientific Outlook on Development and constructing harmonious society, gave full play of the government functions, persisted in the work ways of improving the people's consciousness through propaganda and education, and clearing the market environment through strengthening law enforcement, carried out propaganda education, and training of intellectual property by surrounding the construction target of Year of Intellectual Property Culture, strictly investigated and punished serious cases of infringement of intellectual property, governed the market order intensively, further strengthened the protection of intellectual property, created favorable economic and social development environment and constitutional environment, and increased the abilities of institutions and enterprises in the creation, management, protection and application of intellectual properties, which promoted the rapid development of intellectual property undertakings.

Chapter (I)

    In 2007, the functional departments of intellectual property of the city cooperated actively and engaged in their own duties, and thus made significant progress in the protection ability and law enforcement level of intellectual property protection in the city. Firstly, in the creation of intellectual property, the principal status of the enterprise is attached with great importance, and the applications of patent and trademark registration are strengthened. In 2007, the applications of the city of patents reached 8030 pieces, 18.24% higher than the same period of last year, including 3410 pieces of invention patents, 1.55% higher than the same period of last year; 2295 pieces of practical applicability, 14.59% higher than the same period of last year; 2325 pieces of layout design, 62.54% higher than the same period of last year; 62 pieces of newly recognized as famous trademarks of Nanjing City, in which 34 pieces of trademarks were recognized as famous trademarks of Jiangsu Province by Jiangsu Administration for Industry and Commerce; and 9 newly increased well-known trademarks. Secondly, in the protection of intellectual property, continuous investigation, punishment and renovation are exercised. In the year, the city accepted 9 cases of claiming of disputes on patent, recorded 7 cases, heard 9 cases, terminated 4 cases, ended 9 cases; established and prosecuted 130 brand violation cases and fined RMB 4,159,000; investigated and prosecuted 18 network infringement cases, deleted contents of infringement, shut down infringement website, and expropriated infringement servers. The court accepted 468 civil cases of intellectual properties with related claiming sum of 0.157 billion yuan; heard and ended 462 cases, in which 130 cases were ended through judgment, 31 cases were ended through mediation, 276 cases were ended through withdrawal, and 25 cases were ended in other ways. The rate of mediation and withdrawal reached 68%. In the ended cases, no cases were forwarded for retrial. In the year, nearly ten million yuan was judged to compensated to the plaintiffs; the public security organs of the city detected 301 cases of intellectual property infringement with the involved sum of 68 million yuna, successively captured over 0.55 millions illegal piratical CDs, over 3600 books and magazines, arrested 374 criminal suspects, detained 157 persons for criminal reasons, arrested, directly appealed and reeducated 53 persons through labor.     Nanjing Administration for Industry and Commerce continued the recognition of famous trademarks according to the regulations under Method on Recognition and Protection of Famous Trademarks of Nanjing City . In 2007, the administration recognized 62 pieces of famous trademarks of Nanjing City , and carried out renewal on 95 pieces of famous trademarks whose valid period matured. In 2007, 34 pieces of trademarks in the city were recognized as Famous Trademarks of Jiangsu Province by Jiangsu Administration for Industry and Commerce, and 58 pieces of famous trademarks whose valid period matured were renewed; and 9 trademarks were increased as well-known trademarks (Yurun, Besura, Hisap, Jinsheng, Hongbaoli, Hems, Yingtaiqing).     After completing the promotion of software with legal edition in the government, the municipal intellectual property administration deepened the same work, and advanced the promotion of software with legal edition in the enterprises in the whole city. The administration held two terms of training class of promotion use of software with legal edition for the enterprise principals, and confirmed the first batch of enterprises with full use of software with legal edition. Through the methods such as propaganda, education, training, the enterprises' investigation and correction, administrative departments' investigation and verification in the enterprises, the promotion of software with legal edition was deepened. At present, 21 enterprises have succeeded in the inspection of first batch in using software with legal edition. For the second batch, over 20 enterprises have submitted application, and a new round of similar work will begin.

    The Administration conducted special renovation activity of striking online infringement. In 2007, the municipal intellectual property administration, through full cooperation of the municipal public security bureau and telecommunication bureau, investigated and prosecuted 18 network infringement cases, deleted contents of infringement, shut down infringement website, and expropriated infringement servers, which effectively beat the online infringement activities.

    The Administration carried out the activity of beating infringement and pirate. The criminals in the two cases were criminally punished. The criminal penalty on the activities of illegal sales of infringed publications was the first case in Nanjing City and the state. In October, the Administration cracked another case of pirated music textbooks and captured over 10,000 pirated textbooks. Meanwhile, the Administration hunted down two dens engaging in the distribution of pirated books through the Internet, and captured large quantity of suspected pirated books on sale and over 2000 self-carved pirated teaching assisting CDs.

    The Administration carried out concentrated renovation in the audiovisual product market of the city. At around the Spring Festival of 2007, the municipal office for fighting against pornography, illegal publications and piracy successively cooperated with the public security bureau, cultural department and municipal appearance department conducted large scale activities in Zhujiang Road and Matai Street with serious problem of sales of pirated CDs. The departments dispatched over 500 person-times of inspectors, inspected over 50 audiovisual product shops and stalls, and captured over 300,000 pieces of various illegal electronic audiovisual products and pirated software.

    The Administration destroyed the infringed publications. At forenoon of April 14, 2007, the Offices for fighting against pornography, illegal publications and piracy of Jiangsu Province and Nanjing City held Jiangsu & Nanjing Field Meeting of Concentrated Destroy Activity of Illegal Publications in Spring Battle of 2007 National Activity of Fighting against Pornography, Illegal Publications and Piracy . In the year, the courts accepted 17 foreign-related cases of intellectual property involving 8 counties and regions, namely, Germany , France , American, Sweden , Canada , Jordan , Japan and Hong Kong China , including 12 cases of patent disputes, 2 cases of trademark right disputes, and 2 cases of unfair competition disputes.     In 2007, the courts of the city ended 14 cases of the first trial of the intellectual property such as infringement of copy right and business secrets and counterfeited registered trademarks, and sentenced 30 persons, including 1 person in 1 case for the crime of counterfeit of registered trademarks, 2 persons in 2 cases for the crime of sales of commodities with counterfeited registered trademarks, 22 persons in 9 cases for the crime of infringement of copyright, and 5 persons in 2 cases for the crime of infringement of business secrets; ended 2 cases of the second trial of infringement of copyright and sentenced 11 persons. In the case Chen Hezhong, etc. infringed copyright, the activities engaged by the defendants caused bad social influence and the court gave guilty sentence to 10 persons, fined RMB 505,000, and captured the pirated and pornographic CDs, which gave full play to the judicial protection function of criminal judgment.

    In 2007, the courts of the city continued strengthening the judicial protection to the intellectual property, and actively took the measures of collecting evidences and property preservation according to the authorities. In the year, the courts took evidence preservation measures for 57 times and property preservation measures for 64 times, which fully exerted the special function of civil sanction in the litigation of intellectual property. The courts continued exerted the important function of judicial mediation work in the judgment of intellectual property cases, paid attention to the introduction of conversion from intellectual property to social productivity, and promoted the full realization of inventions as social wealth. The public security organs of different levels of the city dispatched police strength of over 3400 person-times, and conducted special activities including Daily Activity against Pirate , Concentrated Renovation Activity of Fighting against Fake Cigarettes and Special Renovation of Product Quality and Food Security , in which over 800 production and sales location were inspected, 83 dens producing and selling fake goods were demolished, the fake & sham products with the total value of over RMB 20 million yuan were detained, and 317 sets of tools and equipment for production of fake products were captured. On April 15, the Economic investigation Battalion of Xiaguan Public Security Branch found out 30,000 empty buckets with the fake registered trademarks of Nippon and Dulux, and caught the suspect Lin who was suspected of being involved in selling marks of fake registered trademarks. Through investigation, it was found that Criminal Suspect Lin manufactured empty buckets for emulsion paint with fake registered trademarks such as Nippon , Dulux, Zhongnan and Yashili, and the illegal business volume reached over RMB 500,000.

    The public security branch strengthened the propaganda and prevention based on the activity of protecting famous brands of Pingan Enterprise. The public security organs actively cooperated in the work disposition of famous brand strategy of the city, take responsibilities of protection for over 400 enterprises with famous brands of state, provincial and municipal level in the city, and conducted three preventions service, that is, prevent external infringement, prevent internal crimes of the enterprise, and prevent the enterprise's crime. Although Xinshengwei Customs eliminated the suspect of infringement or didn't launch custom protection procedures and released the suspected goods through contracting the obligees and for other factors, the obligees expressed appreciation and thanks to the Customs for the active protection of intellectual property, which demonstrated the Customers' strictness and carefulness in the protection of intellectual property.

    The Customs persisted in legal disposal of infringement goods. Nanjing Customs, according to the guideline of preventing infringing products from flowing into markets and effective use, appropriately disposed the captured infringing products. On October 23, 2007, the Customers carried out the ceremony of Delivering Captured Infringing Sports Shoes to Jiangsu Red Cross Association, and delivered 66700 Pairs of captured infringing sports shoes to Jiangsu Red Cross Association. Jiangsu Red Cross Association issued Certificate of Honor to praise Nanjing Customers' energetic support to the Red Cross undertakings, which achieved favorable social effect.

    The Customs strengthened the propaganda and education of customers' protection of intellectual property. Nanjing Customs strengthened the service concept and law popularization consciousness and carefully answered the consultation from the relevant enterprises and individuals about laws and regulations on intellectual property filing and customers' protection of intellectual property through Director's Private Line of Nanjing Customs. Besides that, Nanjing Customs carried out wide propaganda and education activities on customers' protection of intellectual property in intensive force and innovative ways by full utilization of key theme propaganda activities such as 4.26 Law Propaganda Week for Intellectual Property Protection, 8.8 Customs Law Propaganda Day, and 12.4 National Law Propaganda Day, propagandized the regulations and effect of the customers' protection of intellectual property through several carriers including TV, newspaper, Internet and on-site touch screens, and created favorable atmosphere of intellectual property protection. Several news media including Jiangsu TV, Nanjing TV and Yangtse Evening Post interviewed and reported the Dragon Boat for Custom Protection of intellectual property conducted by Nanjing Customers Office in the Post Office in which several cases of infringing & fake goods were posted overseas through express mails, and achieved favorable propaganda and education effect, which further expanded the influence of customers' work in the protection of intellectual property.

    The Customs strengthened cooperation and formed law enforcement joint power in intellectual property protection. In 2007, Nanjing Customs continued paying attention to the communication with the provincial and municipal intellectual property administrative departments, took an active part in the various activities organized by the provincial and municipal intellectual property administrative departments and actively enhanced the collaboration and cooperation with other administrative law enforcement departments and criminal departments. During the 4.26 Law Propaganda Week for Intellectual Property Protection, Nanjing Customs took part in the series propaganda activities organized by Nanjing administrative departments for intellectual property. In May, Nanjing Customs, together with Jiangsu Copyright Administration and Jiangsu Copyright Association, held a term of training class for the protection of copyright in the import and export trade with the key contents including customs' protection of intellectual property, copyright protection in imported and exported products, and effect of agents, etc., which improved the law enforcement officials' consciousness and ability of exercising copyright protection in import and export trade. According to the Explanation from the Supreme Peoples Court and Supreme People's Procuratorate on Several Problems in Applying Laws in Cases of Infringing Intellectual Property and Interim Provision from the Ministry of Public Security and General Administration of Customs about Increasing Cooperation in Law Enforcement of Intellectual Property, Nanjing Customs well connected the administrative law enforcement and criminal law enforcement, and handed over 2 cases suspected infringement of intellectual property to the public security organs in the year, which enhanced the deterrent force to the infringing acts.
